Judge Dina Ochoa was appointed yesterday as president of the Constitutional Court (CC), the most important entity in terms of judicial decisions in the country. Ochoa, named in 2016, came to the post after being appointed for that instance by President Jimmy Morales.
In July 2017, the CC ordered the suspension of the activities of the San Rafael Mine as a result of an interim injunction to the Legal, Environmental and Social Action Center of Guatemala (CALAS) because, among other arguments, the Ministry of Energy and Mines he did not carry out the community consultation prior to authorizing the licenses. Since then the file is under analysis in the CC.
To complement the legal analysis, last month three anthropological studies were requested from the Universidad del Valle, the Ministry of Culture and the Inter-ethnic Studies Institute of the Universidad San Carlos.
Ochoa explained that this case has required an arduous legal analysis. "I understand that the drafting magistrate is consulting the file. So far it has more than 200 pages only for analysis, "he said.
The president of the CC insisted on the complexity of the case: "It is a task that will bring repercussions and strengths to the system, which is why a substantial analysis of all the actions is needed," he said. At the same time, he undertook to immediately convene the media as soon as he had his final resolution.
Reasoned votes
In his inauguration speech, Ochoa emphasized that his management will be respectful of the reasoned votes because, to his consideration, they strengthen the democratic exercise of the State of Guatemala.
Vulnerable groups
During the act of inauguration, the new president of the CC, Dina Ochoa, said that among her work plan is to guarantee access to justice for all vulnerable groups, in this sense, one of her first actions will be to build ramps in the CC building to facilitate the movement of people in wheelchairs.
