The deputies of the Pesquisidora Commission must make a decision in the preliminary hearing against President Jimmy Morales.

Although it is the second trial, it will be the third ballot in the hemicycle to define if immunity is waived or not. In the first trial, the issue was discussed twice since it did not obtain the 105 required votes.

The investigating commission, integrated in the session of Tuesday, August 27, must submit a report where it will suggest whether or not immunity is withdrawn.

How did the deputies that make up the researcher vote?  The Congress Legislative Directorate has the record of how they voted on that occasion.

A fact that draws attention is that the deputies voted differently. An example is the case of the president of the Commission,  Luis Fernando Montenegro , who voted against the first time and in favor the second.

The recent case

A complaint filed in February 2018 against the National Front of Convergence party (FCN-NACIN), established that the president, in his capacity as Secretary General,  did not report to the Supreme Electoral Tribunal (TSE), the contribution of resources  destined to the payment of electoral prosecutors.

The authorities established an unreported contribution of Q7,920,375.70

This complaint originated that the authorities requested the withdrawal of immunity to the agent. The Supreme Court of Justice took steps and now it is the Congress that has the final say.
