Cannabis legalization in Germany
The most important thing about the new legalization plans : The release of legal cannabis should happen in two steps. Initially, citizens should be allowed to own 25 grams of cannabis and up to three plants for self-cultivation. Cannabis products should be sold in Cannabis Social Clubs. Here members should be able to legally purchase weed and hash for their own use. If Lauterbach and zdemir had their way, this first step should come into force this year. The Ministry of Health intends to present a concrete draft law in April.
The second step includes a model project in selected regions. Here, an additional commercial sale is to be tested over a period of five years. It is not yet clear when these plans will be implemented, the ministers said at the press conference.
The Nuremberg member of the Bundestag Tessa Ganserer (Greens) sees the federal government's resolutions as the beginning of a new era in German drug policy: "The previous cannabis ban policy has failed." With the gradual legalization, the black market could be undermined, the protection of minors with regard to cannabis could be tightened and the criminal and judicial authorities relieved. "The dealers will probably get angry with the Bavarian Prime Minister today," says the Nuremberg politician. The goal is clear: comprehensive and complete legalization. However, Ganserer regrets: "The currently applicable EU law makes this step-by-step approach necessary."
Finally, the only question that remains is: when is the time? When will the new cannabis laws apply in Germany. "Possibly before the German Bundestag's summer break," Wurth hopes. "If neither the EU nor the Bundesrat had to agree, then that would theoretically be possible." If Wurth's hopes are real, the first step towards legalization could take effect as early as July 2023.
