Here are the 2 options the NDP offered BKM

The potential options are:

1. Amending the Order to add defined timelines to complete key milestones in the further assessment process, such as for PBM to provide a draft SAIR acceptable to the Chief Executive Assessment Officer for review or for the completion of the further assessment process; or

2. Rescinding the Order entirely and proceeding to a decision by Ministers on Morrison with the information available from the previous decision.

SAIR has been a farce from the very start. From all I have read and heard, the gov has never said specifically what new info they want, even when asked by BKM a number of times. The gov has kept BKM guessing for years, as to what the gov wants or needs. IMO the BC Liberals used SAIR as a stall tactic and then the BC NDP had no idea how to manage the situation.

I think BKM are doing what's best if they choose option 2.

If option 1 was chosen, the process would then enable the EA to reflect upon the entire project over again, only enabling the chance of further scrutiny and goal post movement. Not what is wanted. The option 2 was the correct choice, as now it corners the EA to make a final decsion to approve or deny, and there will need to be an incredible case to counter the approval, as the mine has been ...more

I also agree Option 2 is the better choice of the two, with one caveat. With all the delay tactics played by the current and former govt's, my concern is the current Ministers fall back on the former Ministers decision as precedent not to approve, without sufficient additional information. Lawyers love using precedents to support their arguments. Ralston is a QC. Maybe if they can spin it to ...more
