Victoria Gold v Cantex
Mining projects in the Yukon require permits and approvals issued pursuant to various federal and territorial legislation. The major regulatory approvals that must be received for a mining project during the licensing phase are generally a QML, under Yukon’s Quartz Mining Act, and a WUL, under the Waters Act (Yukon). The Eagle Gold Project has successfully completed the YESAA environmental assessment resulting in a positive final Decision. A cooperative agreement was also signed with the FNNND. It took over a decade. All ducks are now lined up in a row.
However, Cantex is like Metalex. In Ontario, DeBeers operated the Victor Diamond Mine with required permitting, all-season ice road and agreement signed with the Attawaspikat First Nation. However, Metalex after years of finally securing the mining and water permits from the Ontario Ministry, it was unsuccessful in getting the same Attawaspikat First Nation to allow an access road to its U2 mine site. The U2 project had consequently withered and died on the vine.
