Selection of Renegotiated Non-Operational renewable energy PPOAs
Dear Ms. Rodrguez:
On behalf of the APER, I hereby request under Law Number 141 of August 1st, 2019, Law of Transparency and Expedited Process for Access to Public Information, copies of documents related to the selection of two projects, Xzerta-Tec and CIRO One (“Selected Projects”), of the sixteen projects that renegotiated non-operational renewable energy Power Purchase Operating Agreements (“Legacy PPOAs”). As you know, the Selected Projects add up to 150 MW, when a total of 593 MW had been approved by the Puerto Rico Electric Power Authority (“PREPA”).
Specifically, we request the following:
1. PREPA’s Governing Board minutes and resolutions related to the selection of the Selected Projects.
2. Letters, emails, and other communications regarding the negotiations with any representative of the Xzerta-Tec project and PPOA that resulted in the change of energy price to $0.09900 per kWh and Energy Escalation Rate of 1%, including dates.
3. PREPA’s Governing Board minutes and resolutions related to the negotiation and approval of the changes of Xzerta-Tec change in price and escalation rate.
4. Notice of the formal adjudication decision of the Selected Projects, including the mandatory information on the term available to pursue judicial review of this adjudication and the forum where such a review petition is to be filed.

5. The studies that PREPA commissioned to New Energy Partners on the feasibility of the Legacy PPOAs and consultations regarding the selection of the Selected Projects.

I sincerely hope the PREPA and ex-PREPA crooks that set up this payola for approval scam have the chance to find their true calling behind bars. It appears that PREB noticed they weren't in the loop (or is it conspiracy) on this.  It is good to see PREB exercising its oversight authority over PREPA. I wonder what a FOIA request would turn up at the FOMB about their staff's internal ...more

Me too Doc.  Still, I can't forget that as soon as Voya releases the funds and the shovels hit the ground at Montalva, it will add several 100's of millions of dollars in NPV to GRB's share price.  It is also the right thing to do during a pandemic.  A lot of people are out of work in PR, especially in that region.  The mostly outdoor, solar construction jobs will ...more
