Canadian Judge Nixes Tussle Over $1.8B Arbitral Claim

Law360, New York (April 3, 2017, 4:51 PM EDT) -- The British Columbia Supreme Court has shot down a suit by activist investors in an energy company over the fate of a potential $1.8 billion arbitral award, saying the investors had failed to show their proposed derivative action constituted a good faith effort to represent the company’s shareholders.

In a Thursday decision, Judge Christopher J. Grauer rejected claims by Ivano DeCotiis and Tyrone Daum that their suit over Petromin Resources Ltd.’s claim to a potential $1.8 billion arbitration award is in the best interest of the company.
