But can anyone sell RHT shares as a tax loss with CTO in place? Did management deliberately screw stockholders or is there another explanation?

If anything they did us a favor imho. This would probably be trading below the current share price with all the negative ,some so far fetched with no prove,just throw it out there and dog pile on. I can wait till everythings in place. HNY EC
