How about this scenario - what are the rules on disclosure of a buyout offer? Is it possible there has already been a bid and ES, Walter and Dino wanted to obtain majority ownership to block a premature lower buyout? - Just spitballing

Jeb, a freindly buy out offer would begin with some discussion from the potential buyer. Even before any buyout offer was made, there may be some vibes as to what that may look like and when it may possibly come. Standard confidentiality agreements and the due diligence effort would likely result in some interacting and thus a "feel" for things by the parties. All speculation on my part ...more

there's no such thing as a friendly or casual offer when talking billions you Muppets. It's an LOI before a discussion even begins, and as CSK has suggested, not disclosing that would be illegal. None of the pumps have clearly done any M&A on any scale in any industry. Whats absolutely mind blowing is the sheer inability to consider that they might be wrong. They aren't colluding ...more
