B.C. pot shop loses trademark battle with Toys ‘R’ Us

A Vancouver cannabis dispensary is going to need a new name and logo after losing a legal battle with retailer Toys "R" Us (Canada) Ltd.

The Herbs "R" Us Wellness Society will have to change its name, a federal judge says. The name change comes after a ruling in favour of retailer Toys "R" Us which argued that the cannabis dispensary violated its trademark in a way that damages the goodwill attached to it.

Herbs "R" Us, which appears to be an unlicensed cannabis dispensary in Vancouver, never responded to the court application, but will still have to destroy any goods, packages, labels, and advertising material that violates the Toys "R" Us trademark.

Toys “R” Us argued that Herbs “R” Us’s green logo with a cannabis leaf in the middle of the ‘r’ uses a similar font and arrangement of letters as the toy store.
