On February 18, 2015, New York State Attorney General Eric T.
Schneiderman and New York City Corporation Counsel Zachary W. Carter
announced the filing of a multimillion-dollar lawsuit alleging that UPS
“unlawfully shipped over 136 million contraband cigarettes – or nearly
700,000 untaxed cartons— across New York State in violation of federal
and state laws.”
The Complaint filed in federal court in Manhattan, alleges that from at
least 2010 through the present, UPS “knowingly ship[ed] and deliver[ed]
thousands of cartons of unstamped cigarettes from manufacturers to
unlicensed wholesalers and/or retailers ... and then again, delivered
such cigarettes ... to residences in New York City and State, and indeed
nationwide.” According to the Complaint, these deliveries “support
numerous illegal cigarette trafficking enterprises,” and rob “the State
and City of millions of dollars in tax revenue.”
The Complaint further alleges that the deliveries also violated an
October 2005 Assurance of Discontinuance agreement that UPS entered into
with the New York State Attorney General, following an investigation
into similar allegations.
The Complaint could result in significant damages against the Company
