Philadelphia, Pennsylvania--(Newsfile Corp. - December 22, 2024) - It is alleged that Shenzhen Smoore Technology Co. Ltd. (d/b/a "Smoore"), the manufacturer of the most popular vape brand in the United States, CCell (generically "510 threaded cartridges") created a "hub-and-spoke" conspiracy between Smoore and its distributors, including Jupiter Research, Greenlane Holdings (and its predecessor, KushCo), 3Win Corp., and Canna Brand Solutions, involving, among other things, minimum resale pricing and no poach agreements. It is further alleged that the goal of the conspiracy was to artificially, fix, raise, and maintain the prices of empty 510 threaded cartridges.

By unlawfully exploiting its monopoly power to exclude competition, it is alleged that Smoore and its distributors have unlawfully foreclosed would-be competitors from being able to disrupt Smoore's monopoly power and pricing, which in turn has allowed Smoore to charge more for empty CCell 510 threaded cartridges than they could have in a truly competitive market.
