When I talked to Eshelman he mentioned this definitely going to a private party for pennies on the dollar. He told me he knew the banks threshold and that they were going to take a haircut. " I will tell you what you wanna hear, shareholders money is gone" was his opening line on my phone call with him. 

 He also insinuated that he could have easily avoided bankruptcy had he waited another week when prices rebounded. But it's over now this is where we are at.

I truly feel they forced the bankruptcy through new CFO, he is a fall man. They could have gotten over the hump easily, bk was strategic
