RE:RE:RE:RE:RE:RE:RE:Management’s Discussion and Analysis March 31, 2024What I wanted to state as theoretical possible outcome is:

The two parties agree outside the ICSID tribunal case in a way as I said. And the case is officially closed according to rule 44 of the ICSID without any ICSID award. To my observation many ICSID cases end like that. Instead of an award decision - the two parties agree on a reasonable fine tuned solution to each other.

Only one example is the case  "Anglo American plc v. Republic of Colombia (ICSID Case No. ARB/21/31)".

In this case (as in many other cases) the ICSID ended its work finally only with some dry sentences- quote:

May 5, 2022
The proceeding is suspended until June 30, 2022, pursuant to the parties’ agreement.
 
July 1, 2022
The Acting Secretary-General issues an order taking note of the discontinuance of the proceeding pursuant to ICSID Arbitration Rule 44.
