This means any expansion to other locations (e.g. west coast of USA) will require Regenx to own/run the plant so that IP is not disclosed to 3rd party.

[108]     I am mindful of the notion that a middle ground solution is not always consistent with the interests of justice. Often one party’s position is entirely sound and must prevail over the position of the other. In this case, the situation is more nuanced. Certainly the stakes are high for both parties. I conclude that the interests of justice favour a limited interlocutory injunction, with terms that would prevent the defendants from disclosing or disseminating to any third party the details of any chemistry or chemical processes pertaining to metallurgical extraction, as previously shared by the plaintiff under the terms of the LOI.
