Let me try something more practical which is actually  happening here:

1.  You own 10,000 CLL shares which you purchase at $1.65 few months ago for the total of $16,000.

2. You have a "good connection' and you can now purchased 10,000 CLL flow-through shares at $1.45 for the total of      $145000. At 40% tax bracket you get the $5800 credit for this year which reduce your cost to 87 cents per share.

3. You sell your original ($1.65) shares for $1.2 (see Sep 30, no news, 8 million shares traded) for the loses of $4000.

Since you can not predict future price of CLL shares you can not  do the final tax calculation but
from the practical point of you , you just replaced your $4000 loses to $5800 gain and still own the 10,000 CLL shares
at much lower price.
