Very unlikely... even remote.
I am fairly sure DNI will take up the offer of closing the arbitration without any damages if Cougar were to offer it..... in fact, Dan ight even be willing to pay a small sum (not bcos DNI is at fault... but as a human gesture towards the expenses incurred by Cougar) to Cougar to close the matter. Why will Cougar pay DNI at this stage?
