Question:
To ask the Minister of the Environment, pursuant to AQW 38000/11-15, whether his Department has moved to stop all works pending the outcome of the Department's live enforcement investigation, given the close proximity of Owenkillew Special Area of Conservation, the strict requirements of the precautionary principle which underpins Article 6(3) of the Habitats Directive and the fact that the manner in which this case was handled is currently subject to infringement complaints lodged with the European Commission.
Answer:
The Department, having engaged promptly with the developers of the Dalradian site on Camcosy Road, has received a written statement that works have ceased in regard to the alleged breach.
Officials have been monitoring the site and will continue to do so.
