Please note I am not a lawyer. The following is advise you should vet with a lawyer. Your situartiuon will be different to mine given each CCAA is unique.
The questions that I have asked in my situation was:
- Does the lawfirm work on continguency? If yes, what percentage will they be taking should they win? Is there any costs encurred by you should the law firm lose? Does lawfirm cover the costs of appeals in Prov and Fed appeals courts. Make sure this is stipluated in the client contract you sign.
- Is there a steering commitee governed by the share holders? In other words, who is the share holder or group of share holders interfacing with the lawyers? There has to be at least one name (plantiff) on the filed lawsuit
- Where is the money coming from? Carve out on the PGM estate? Executive owned assets? Officer and executive insurance?
- Is there any prior court precedences (rulings) they are using in their lawsuit? This increases the odds of winning should the same situation occured in another lwasuit and the plantiffs won.
Give them a call and make sure the consulation is free before proceeding with a meeting. Lawyers are NOT charity organizations.
