Husky's project may not necessarily automatically require a review, there needs to CEAA trigger. The devil is in the detail. If they did a proper impact assessment prior to making application; and the triggers were mitigated or avoided they could get through the review unscathed. In reviewing Huskys previous applications they went to extensive lengths to engage the first nations which in turn de-risks the aboriginals from submitting the statement of concern; statements of concern with identifiable merit almost always trigger a review.

As there are oil and gas developments in the area currently (Norman Wells) it lessens the potential for adverse impact unless the intensity of development is deemed to be adverse; like in the Fort McMurray mining activities.

I suspect the MGM folks had proposed to pull water from a water body that had the Cisco identified. It may have been an oversight on the part of MGM. I suspect Husky had taken that into the planning assessment as they are generally familiar with preparing large scale project applications that are planned to avoid CEAA reviews.
