The highest court in the US has outright denied Alaska's petition.  That means even IF lower courts accept and an appeal sent to SCOTUS they will not hear. 

Alaska circumvented lower courts knowing they would not hear. Strategy failure.

Your logic is flawed. Not taking the case directly or immedietaly  now means they wanted the process to go an lower level at. first. You cannot know neither  if they would refuse to take it after lower courts appeal, nor whether altough take it but dismiss or deny the motion. You always seem to be logical, this time you are wrong
