Aduviri playing his last card to get freedomOn June 3rd, before the Supreme Court, Aduviri plays his last card to get freedom Next June 3rd, the Supreme Court of Justice will analyze and qualify Resolution N° 117 of the sound case of Walter Aduviri Calisaya, who purges condemne in the Yanamayo Prison, of 6 years in jail and payment of 2 million PEN for the damages during the "Aymarazo" in 2011. The hearing has been set at 8:00.
It should be mentioned that in a previous instance, the First Criminal Appeals Chamber resolved to grant the appeal for annulment filed by the defense of the imprisoned regional authority, against judgment No. 262, contained in resolution No. 116-2019.
It should be remembered that Aduviri Calisaya was sentenced and his sentence was confirmed, and that his lawyers considers this decision to be disproportionate and unfair, and therefore they resort to cassation (Recurso de casacion).
On January 7th this year, attorney Aldo Valdivia Vega presented the document where he filed the exceptional appeal. Two days later, the said chamber granted the request and they also decided to set a new procedural address.
The defense of Walter Aduviri, insists on considering that the charges are incongruous since he only led the protests and that he did not commit nor he ordered the May 2011 riots where public and private institutions were destroyed and looted.
Despite the fact that there are no videos or audios that implicate him, the courts applied the theory of non-executive co-authorship, arguing that he did have command over the actions.
