I would like to see the rule of law followed to the letter too. But what are you supposed to do when it isn't. If Donner was negotiating with some brokers for a private placement and decided the SND deal suited them better they would have to tell the broker as soon as possible so they stop wasting time trying to price the market. It would not be too much of a stretch for the broker to figure out they are going with SND again and for the broker to frontrun the announcement. It is hard to stop and may not even be illegal. ( I do not know the rules that well) Either way, it sure seems to happen. As an investor, I try to figure out what is happening in the markets and it sure looks like SND got a pop in share price and volume prior to the announcement.
