No. Cameco has no where near 900 mil in liabilities with the CRA. Cco is close to a 5 year high. I need it lower to fill the shares I need and this spot issue may help my cause in the short term. 1-2 years.

Supreme court is the ultimate decision maker and can change the tax laws. All the lower courts are impotent on that respect. This will be a historic case that can change transfer pricing rules regarding companies that have no productive operations overseas but simply use a marketing office as a subsidiary for that purpose. For one, the court has not decided if it will hear the case and it may choose not to. Secondly, the court sets precedent based on existing laws they DO NOT make the law themselves.

Yes thats what i meant. Just semantics. If gvt wins in supeme court the tax treatment in all such cases will change

I think it's actually an important distinction to make. The CRA seems to be making an appeal to what is "fair" rather than what is tax law. During the inital tax trial the CRA referenced OECD guidelines rather than Canadian law. The judge ruled emphatically in Cameco's favor because they were following Canadian tax code and essentially chided the CRA for attempting to apply ...more
