RE:RE:Vern Yu LetterYou guys are applying sound logic and reason, but forgetting this is more of a political issue than an engineering or legal one. Politicians like Biden don't give a rat's a$$ that they signed these federal laws in the 70s and 80s, and neither does whitmer, because they think they can sway this in their favour by virtue of an agenda of fearmongering. Not only that, but the judges presiding over these cases will also be swayed by political leanings. I hope I'm wrong but we have seen plenty of judges that act solely on political discretion and influence.

Unlike other sections of the letter, ENB does not openly refute the existence of violations of bend radius, which is disappointing. It thus appears highly likely that the pipeline fails to meet this criterion of the easement. What possible actions ENB can take to correct it is unknown. I suspect there are in fact none that are technically and financially viable, except complete replacement of the existing line with the tunnel project. All other rebuttals to the claims in the state's notice to ENB appear bulletproof.
