Fortune Minerals Ltd is a Canadian mining and mine development company focused on developing the NICO Cobalt-Gold-Bismuth Copper Project in the Northwest Territories. The company plans to build a hydrometallurgical plant in southern Canada to process NICO metal concentrates. The thing with the supreme court, nothing is "grandfathered". We have to be really mindful with rulings that occur from the supreme court because it allows other indigenous nations to reopen disputed issues. Especially, if it was determined that the decisions of the past were wrong. 

Not that i personally see a reason for it to matter right now in this case but for future cases with other indigenous groups that take their claims to the supreme court, it is important to recognize the case law implications it can have on canada. 

If anything, the supreme court is the "grandfathered buster" in most situations
