If the Canada Federal Court of Appeal throws a decision in favour of the proponent TMX, it's all but certain the SC will reject to hear any FN appeal the decision. If the Fed Court rules in FN favour, Canada will do a final repeat of expedited consultations, and any new appeal to the Federal Appeals court on grounds of 'inadequacy' will be promptly quashed. TMX is getting positively resolved (in Canada's favour) within two years absolute worst-case.
In the case of L3RP MN PUC will re-approve before summer. The scope of objections available to the opposers has been dramatically narrowed by the repeated passes through the courts, and any new appeal of a new positive PUC decision will certainly be quashed in short order. L3RP is a go by mid-2021 absolute worst-case.
Those 1000's of lawyers will have to find alternative projects to build their CV's on. Maybe they can go fight PBA's JC LNG project, as the KXL case will also wrap up by summer. Canada is going to get not 1, not 2, but 3 new pipelines.
