This is essentially the same things as saying this property - which was given the go-ahead by the state for mining - is now off-limits period. You could say that it was only approved for exploration, not for mining, and that is true. But what company is going to put millions of dollars into a project that they know is going to be shot down no matter what mine plan they come up with?
Clearly, the EPA has over-stepped its authority in pre-empting a decision. That is the issue that needs to be corrected. If Pebble is not going to be acceptable to the people and State of Alaska, fine, but at least let them decide. And if it's going to be blocked by politicians in Washington, it does seem there may be cause for compensation of sunk costs.
Although judging from history, good luck with that.
