When the purchaser bids on the property, this is part of the due diligence as it is registered against the property. ABX can't win this case in Canadian courts but it could be done to penalize NGD as it will keep their share price down in the short term. In addition, it will be difficult for NGD to raise new money in the short term. ABX is making a point but this will not impact NGD in the long term. All Canadian laws were followed by NGD (in my humble opinion). I am a purchaser of the NGD shares and A warrants at current prices. The NGD share price will recover after the lawsuit is over.
