They claim force majeure and government overregulation.  Problem is lack of government reg was the root cause of their impending extinction.  CCO will ultimately prevail in court but there's blood and there is stone.  Fukushima is going to cost a minimum of $188 billion to clean up!  

And the rest of Japan has apparently joined the same sad sack Tepco-lead floatilla:
