Primary Symbol: PHO

The investment seeks to track the investment results (before fees and expenses) of the NASDAQ OMX US Water IndexSM (the underlying index). The fund generally will invest at least 90% of its total assets in the securities that comprise the underlying index. The underlying index seeks to track the performance of companies that create products designed to conserve and purify water for homes, businesses and industries. The underlying index may include common stocks, ordinary shares, American depositary receipts (ADRs), shares of beneficial interest and tracking stocks. The fund is non-diversified.

RE:They Both KnewDueck clearly knew it was wrong.  His other business must have been in pretty bad shape to try something like this.  

But I don't see what personal benefit there would be for Weston.  He also reported it not long after it occured.  I think it's plausible he didn't understand how bad it was to do this and he must gave gotten a lot of pressure from Dueck.  I'm not sure if losing out on president / CEO position is a big benefit for him.

As you said, better controls and safeguards will be a benefit for the future.  And assuming they get the full amount back this may end up having some positive effects.  I am still concerned that 
Dueck holds a significant portion of Photon R&D, Also I assume DCD Management Ltd. is his own company.  So management will need to give some comfort that there's nothing shady going on with these companies either.
