It takes a bunch of new eggs and puts them in a new basket, as a backstop to the current group of 18 action, and starts to prepare the growth path beyond whatever settlement they get next year. Litigation costs for this one shouldn't peak until after settlement $ available. So, great. But what about the tactics of doing it while Markman decision is still in development? I'm not a lawyer, maybe somebody out there has thoughts. Is there a danger that the attitude of the court to Win could be affected by Win heaping on more litigation at this point, before decision is released in Markman? Could Win have detected unfavorable winds on the Markman hearing, and are hastily trying to get some other action going? Or....?
