and has been used from day one.
It really is not a workaround at all, but simply a use of a Fixed Rating Table, which will remain in place until the broadcasters begin to broadcast the NEW rating table # 5.
Howevever ALL TV makers have already used SIMULATED rating table 5 broadcasts, in order to comply with FCC regulations that insist that they prepare for the NEW rating table #5 broadcasts.
In doing so , ALL TV makers have allready Violated ALL steps of the disputed , section / claim 7 of lthe 402 patent.through extensive testing and required document submissions to the FCC.
Without a doubt, all of this will be presented by Wi-lan at the upcoming Appeal Process(es). Wi-lan did well by NOT wasting further effort in presenting this valuable evidence to Dumb & Dumber, of the present NY court."
