RE:Biden and IP

RE:Biden and IPInteresting article but I'm not terribly concerned regarding Quarterhill / Wilan for two reasons.

First, in 2020 it is a very different world re patents and big tech than it was in 2011. There is now, I think, a widespread understanding that the changes under Obama went too far. There is also surely less sympathy for the tech monsters now that they've so obviously become the prime beneficiaries of Covid-19.

Second, Wilan appears to have shown that they've gotten pretty darn good at negotiating the current system. While the PTAB and IPR review has been a source of huge frustration for many patent holders, Wilan, among others, has shown that if you understand your patents and know how to move the process forward, you can prevail within the system.

The huge challenges in turning patents into $$ are not so bad for Wilan if it means it will improve the availability of high-quality patents (and lower the effective price). It will also tend to reduce the level of competition within the patent-monetizing space.

Everyone in the patent world dreams of Alice being overturned. I'm not so sure it would be a great thing for Wilan. It might mean that, in order to get court time, Wilan would suddenly have to wait in a very long lineup behind the holders of all sorts of patents that, within the current framework, are just junk.
