If it's the second verdict of 45 cents, my main concern would be the Samsung issue that was part of the court documents. The argument the WiLan seemed to be making was that if they took a settlement at too low a price, then that would invoke a 'most favoured nation' clause in the Samsung agreement and then we woiuld have to pay back money to Samsung. If this is the case,at what level would this happen - not sure the court documents went into that detail. So it would appear to me that if the judges award us with a 'win' with Apple it may not be enough to make it a financial win when the Samsung adjustment is made.
Do you think this is a concern?
PS. Cabbie, I was also surprised the Samsung settlement wasn't brough up in the orgal agruments on Friday.
