Quarterhill Says US Appeals Court Rules in its Favor and Against Apple in Patent-Infringement Case

02:24 PM EST, 02/04/2022 (MT Newswires) -- Quarterhill (QTRH.TO) on Friday said the US Court of Appeals for the Federal Circuit ruled in favor in a patent-infringement suit its WiLAN unit filed against Apple (AAPL).

The company said the three-judge panel "agreed with WiLAN's claim construction arguments relating to the patents-in-suit" and in favor of its patent infringement claims.

"With these two rulings today, the (court) has conclusively decided that Apple infringes the patents-in-suit and is liable to pay damages to WiLAN," it said in a release.

The court also reversed a decision from the US District Court of the Southern District of California that ruled Apple products containing Intel (INTC) wireless chips that used some WiLAN technology should be excluded from damage calculations. Though the appeals court disagreed with the company's calculation of damages and remanded the case back to district court for a trial to determine damages.

"Overall, we see the CAFC decision as favourable to WiLAN and consistent with the arguments heard at Oral Argument. We remain committed and focused on advocating our positions which we believe are fair and balanced. At the same time, we always remain open to resolving any litigation disputes through reasonable negotiated solutions," WiLAN chief executive Michael Vladescu said in a release.

Quarterhill shares were halted prior to its release and no timing for a lift to the halt has been released. The shares last traded down C$0.23 to C$2.30 on the Toronto Stock Exchange
