Can't read the article because of paywall, but the little I did read doesn't sound good.

Google squeaked though but this case is long from over. We have 6mths to file for an appeal at the PTAB.  https://www.uspto.gov/patents-application-process/appealing-patent-decisions/patent-trial-and-appeal-board-ptab-faqs#type-browse-faqs_459

Sorry, Google squeeked through what? The most recent I've seen re IPA vs. Google is three September PTAB decisions that were all wins for IPA. I'm not inclined to sign up with Law360 unless I really have to. Can you give us a summary?

Okay, I found them. https://www.uspto.gov/patents-application-process/patent-trial-and-appeal-board/decisions/ptab-report/currentreport.html

This battle has been going back and forth as you can see. Its long from over..  Google Loses PTAB Challenge Of Siri Tech Patent Law360 (September 4, 2020, 6:00 PM EDT) -- The Patent Trial and Appeal Board has upheld all 10 claims in an IPA Technologies Inc https://www.law360.com/articles/1307539/google-loses-ptab-challenge-of-siri-tech-patent

I think they won some and lost some at PTAB.  I am asuming this article is just focusing on the ones we lost?  And ignores the wins, since they already talked about those in another article?  (Though you think they would mention that...)

We won in PTAB on these claims in the case. https://s3-us-west-1.amazonaws.com/ptab-filings%2FIPR2019-00731%2F73

There were several patents in this case and some have already cleared PTAB.

Yes, though I noticed that there were some '560 claims that got a pass in September but that were found to be un-patentable in this most recent IPR (presumably on the basis of a new argument). I was a bit surprised that that would happen.
Comment by wilander on Oct 17, 2020 9:14pm
Yes, it seems only claims 28 and 52 of the 560 patent  from the September decision are now left "patentable" against Google. It seems the remaining ( 1, 20, 21, 26, 27, 29–35, 45–49)  were overturned as unpatentable against Microsoft, to which I believe IPA can challenge? Seems odd they were deemed patentable against Google in Sept and then non-patentable against ...more

I would like to add come comments which may clarify some important facts relating to Siri Article and case in general. On March 28 /2018 IPA Technologies filed request for jury action for damages for infringement in 109 page document.  In this document IPA asserted patent ownership for 6 patents as follows: Patent 115 number 6,851,115 which contained 6 independent claims & 89 total ...more

And there in is the important part.  How many patents and claims remain to go to trial and how strong are they. In the APPL case just a few claims of two patents actually went before the jury. VnL

Here''s a simple historical ref/sum of what happened to 3 of the 6 patents originally asserted. https://www.theregister.com/2019/01/24/google_siris_patents/ How much of the 560 has survived the assault by Google and MS? Not excluding any successful appeal to the IPR decision. 128 appears to be out. Here''s the two IAI IPR decisions @ number 5 and 6 down the list of decisions ...more
