Cross Appeal Impact

In my opinion, Wilan's cross appeal has:
1) Increased the likelihood of a positive result for Wilan at CAFC.
2) Increased the likelihood (although still low) of Apple settling before the CAFC trial begins.

I agree on your first conclusion.  The laughable error by the Apple expert to include the $0.50 / unit by HTC and then his approach to exclude HTC and BlackBerry (the highest and lowest license) to develop a rate is hilarious.  Then in the record, at cross, the expert agreed HTC is the most comparable to Apple is incredible.  The jury verdict will stand as the rate is consistent ...more

V_guerriero, you raise an interesting argument on my second conclusion - namely that Wilan could refuse to settle even if Apple agreed to the last award. I was looking at it from the opposite perspective. If Apple risks the per unit license rate going from .45 to .85 if they lose at CAFC, does Apple really care if they have to pay $200 million USD more (for all iPhone models) or does all that ...more
