Dated June 4th..."Appellant Apple Inc. and Cross Appellant Wi-Lan Inc. state that they have discussed settlement of the above referenced appeal.... the parties have not reached an agreement regarding settlement of this appeal"

... so it looks like they do talk and this is going to be decided by the courts.
