Case against Amazon dead?

From Docketbird this afternoon Orders 406 & 407 do not look good. I wasn't able to copy the text.

If this is only an adverse interim decision then maybe the action is still alive? But Judge Andrews sided with Amazon on everything.

If it is dead then I would assume the parallel actions against Microsoft and Google should also be dead.

Not good.  Case is closed.  Probably will affect teh Google/MFST action, but maybe not.  Wilan may appeal.  Have to wait. Here is the Judge's rationale: DISCUSSION One of Amazon's multiple non-infringement arguments is that Alexa does not meet the ICL service request limitation. All asserted claims require an "inter-agent language" or "interagent ...more

As I said in a previous post this had a 10% chance of making it to jury trial as it was not a standard essential patent.   The judge took the easy route, didn't have to oversee a jury trial or rule on 20 other pre-trial motions. Just wrote a six page decision of non infringement accepting the Amazon argument at face value and sent it to the CAFC.  Standard practice in patent ...more

if there's urgency to acquire ITS assets, its hard to count on patent assertion to reliably deliver. This case has been ongoing for 5 years. I stand by my thesis and rationale why the Wilan sub could be divested by Q1. The court has assigned a value for the siri IP at zero, for now anyway. Next up, Apple.

The wireless, semiconductor and dram patents all have key patents that read on essential standards. The Amazon case was very low probability, but very high value.  It was also financed under partnership program so limited expense.   Next stop is a motion for judge to reconsider his lazy decision or appea to CAFC.

I think SRI licensed the patents concerned to Apple more than 10 years ago. What's happened since then must, I'd think, be the ultimate case of a body of impressive IP being endlessly nitpicked to death, now possibly whittled down to nothing. It reminds me of various nature shows about the wild dogs of Africa. Not a perfect metaphor, of course, because it was IPA that initiated the ...more
