You raise a good point, by endo agreeing to a share of the future revenue, that suggests that they still have faith in Urocidin. But what choice do they have on the other hand? They can't ask BNC to pay back the milestones. They screwed up on the trial design. Either they get nothing in return for ther time and effort in messing things up and investment, or hope for some miracle that BNC can do things right and pull through.
I agree with you. Since they focused the trial on refractory, we should only give them royalty fron revenue generated in the refractory cases. But BNC is not in the position to negotiate and the world is not perfect. I bet BNC had to beg them for the return of control.
