Running a trial is hard and can be tiring if you are not really up to the task. It is a whole lot easier just to lay everybody off and sell the company at cash. 3 years running a company is a long time if you never had your heart into it. Easier to sell it for 14 cents to a local buyer and get the full exit package you are entitled to contractually. The x factor is the shareholder reaction but there is no fight left and thought of not selling and watching management squander away 35 mil is a distressing nightmare after what they have been dragged through. Easiest exit plan is to sell for CV. Non cash assets are pretty much worthless
