We are nearing the end of the Ontario Land Tribunal hearing with final oral submissions on Monday, February 14 and written closing submissions due Thursday, February 24. It is predicted to be anywhere from a few days to one month before the Tribunal releases their decision. There was strong testimony explaining that there is not an acceptable storm water management plan. We are hopeful the adjudicators understood that. Given that the KNL lands north of the golf course have been working on a storm water management solution for that area for the past 10 years that would feed into the same water management system, and the fact that there is a 40% agreement protecting the golf course lands, to me, the trial seems like an academic exercise. As has been articulated to me, we have spent 4 weeks essentially saying, “Well, if there weren’t a 40% agreement protecting the lands from development, if there weren’t any rights of land owners who bought their lots at a premium because they backed onto a golf course, if there weren’t restrictive covenants in place, if there weren’t contamination challenges…and if there were an acceptable storm water management plan, then, I guess, in an alternate universe we could consider ClubLink’s plan.”
