Reading the SHORT FORM PROSPECTUS of the series one, there are some other elements and options that many posters may not have considered.

First, are the dividends actually an obligation if they are not declared by the BOD?

"....will be entitled to receive fixed cumulative preferential cash dividends, if, as and when declared by the BOD......"

Second, If the BOD wished to restore investor confidence and not alienate future investment , wouldn't a suitable option for exchange be, to exchange for newly created units with similiar parameters as existing series 1 but with an adjusted timeline for redemption. (or negotiate that timeline extension within the existing prospectus)  

It is in the company's best interest (if they wish to attract future investment from equity markets)  that share holding participants feel that there is opportunity for gain and that the company respects their position.
