You will find this paragraph in probably every mining companies report. Someone has petitioned the EPA go after a rule change in the mining act to say that mine waste is not mine waste, but a separate waste product. like waste from the milling process is not a mining waste, the liquid in the tailing ponds is not a mining waste..etc.
Every mine is affected by this proposed change including the likes of Barrick, Newmount etc. I can't see the US Government shutting down all their mines when the Feds and states receive royalty payments from the mining process.
What we have here is a bunch of tree huggers trying to close mines
