RE:RE:RE:RE:RE:RE:RE:“In Our Favor” ??? Ya, I don't see it that way. For Q3 PSF sold all of the product and expect in Q4 they will do the same. You have to assume the price PSF will get is at market. If not then EMH has potential re-course and that is now under review for Q3. If there is an issue it is with the market price not EMH signing up to a higher fixed price (at the time it looked like a discount). That was a mistake but if PSF cannot sell their product to someone else at a reasonable price it is a bigger problem that hits all companies. Supply agreements are not intentionally structured to place a premium onto the customer (EMH).
As it relates to the D2 funding PSF has $44.06M of the required $50M from shareholders. They also have $26M by way of a demand loan (VFF/EMH $13M each) and another $20M credit facility with Credit Farms Canada. Lastly in section 7 of the shareholder agreement it clarifies the funding obligations of the shareholders should there be need for additional funding. To date no “contribution notice” has been issued.
