My understanding is that CDO's lawyer recommended that CDO not sign unless the first tranche of Pepper's commitments for work on Murphy Lake ( I think it is 1 million) be put into trust or escrow.  The chances of Pepper being able to do this are slim to none.  Good advice by CDO's lawyer, and good caution by CDO.
