NIS New Tender Well 1201 in Blk 8

WHEREAS: (A) NIS is Title Holder and Operator in the Petroleum Concession Agreement for Block EX - 8 Block (the Block) where Teremia 1201 Well (T-1201 Well or the Well) is to be drilled, tested and completed; (B) For above-mentioned drilling project, NIS requires certain well reated goods (i.e. casing, steel grade with buttress connection and pup joints), as per the Companys Technical Assignement attached hereto as Annex 1 (Technical Assignment) which Seller is willing and capable to provide as seth forth under Sellers Revised Bid Form no. [] attached hereto as Annex 2 (Sellers Offer) and, as confirmed and described in the Confirmation Letter no. [] attached hereto as Annex 3 (Confirmation Letter) issued by NIS to Seller (hereinafter referred to as the Goods); (C) The quality of the Goods to be provided and the deadlines to be observed are of the Agreements importance for the Buyer; (D) NIS and the Seller have discussed, negotiated and expressly accepted any and all of the terms of this Agreement, including all conditions defined as non-standard by article 1203 Romanian Civil Code;
