There was absolutely never a time I commented the project can't move forward based on the expiry of the Master Development Plan.
I did question, sometime ago, who would move forward with buying the project when there is a legal dispute involved with the project.
But thankfully Jeff denied it even exists.

The reality is that the court is in a position to execute or deny the project.
Undeniable.
You stated it with Jay's quote.
Greenbriar loaned the monies to PWR needed to continue advancing the engineering. 
Read it.
Captiva should in all its power enforce the option of force majeure when the lawsuit is not only apparently it's not Greenbriar's issue, then it is 100% outside of PWR's control.
