Again you fail to post the entire written discussion from the Planning Director Jay Schlosser to the Planning Commission last week.
 
Jay stated verbatim:
 
Jay responded to questions from commissioners and noted that the lawsuit does not prevent the developer from moving forward with the project.
 
“Our legal team tells me that state law is very clear that a project may advance until the court says otherwise,” he said. “And the court hasn’t even reviewed (the) documents yet. So there is no reason they could not advance the project over the last year.”
 
So Shneps, if the City says the project is going forward and the Water Districts action against the City does not stop Sage Ranch and Greenbriar is spending the big bucks doing the detailed engineering work, how in the world can Captiva serve force majeure on Greenbriar or the City
 
You prove constantly you do not post completely what you Google. 
 
Captiva is out of money for a long time. It lost its interest. It's only hope is kindness from GRB to let it have its money back. IMHO

It was GRB that requested the extension based on the legal dispute not the City. I don't dispute the project can't move forward at all. My point is that Jeff denies there is any legal dispute. Please post your link to the quotation from Jay Schlosser as I don't see anything directly quoted from Jay in the October 10th meeting.

To be fair to shneps - He has a valid point about the lawsuit (not saying it will go forward or anything will happen.) All Jeff needed to say is there is a "lawsuit which we believe is without merit and our attorneys are working on it" - This happens ever day with land deals. All I seen(I could be wrong) - Jeff has said multiple times GRB is not involved in any lawsuits. NB

Jeff also commented that a settlement deal had been submitted to the City for a resolution by the Water District. Why did the City decline the settlement offer?

Shneps: There many reasons why the city declined the settlement offer - not all offers are fair offers. Let's say they (this is makeup offer) asked Sage Ranch reduce the number of houses from 995 to 100. This would not be a fair offer. NB
